Brafman team points the finger at DA manipulation of media environment, hires top detective agency.
The trial of Dominic Strauss-Kahn on charges of attempted rape was shaping up last night to be something of an epoch-defining case. While New York DA Cyrus Vance Jr has brought in Hate Crime veteran Joan Illuzzi-Oborn to position the former French boss of the IMF as a monster, DSK’s lawyer Ben Brafman has already signalled his intention to challenge the media depiction of the accuser, Nafissatou Diallo. By the time this is over, we may have witnessed an epic battle between politically correct gender delusion, and the silent majority who would prefer a return to balance and reality.
The Strauss-Kahn legal team yesterday expressed concern that “our client’s right to a fair trial is being compromised by the public disclosure of prejudicial material even before these materials have been disclosed to his counsel.” Specifically, the celebrated master of acquittal suggested that they hold information ‘likely to undermine the credibility of the hotel housekeeper’ Nafissatou Diallo, the woman accusing DSK of attempted rape.
The threat was made in a letter sent by Brafman’s team to Cyrus Vance, the Manhattan district attorney, and asked him to do whatever he could to stop law enforcement officials from leaking information in the case. From my perspective, it sounds like an empty threat: if he had something, Ben Brafman would be leaking it by now. Allegedly.
Specifically, the letter claims:
“….were we intent on improperly feeding the media frenzy, we could now release substantial information that in our view would seriously undermine the quality of this prosecution, and also gravely undermine the credibility of the complainant in this case…..”.
To hint at damaging information about the victim without revealing it is of course an old legal trick in the States, because it sets hares running in the prosecutor’s office. In this case, it will probably do that, because as the Slog previously revealed, there do seem to be a number of ‘facts’ about Diallo not entirely in keeping with the veiled-Muslim-goody-two-shoes image donated to her by the DA.
Vance’s office quickly got its own letter off, asking with large tongue in bulging cheek, “If you really do possess the kind of information you suggest that you do, we trust you will forward it immediately to the district attorney’s office”. In other words, “put up or shut up” – but it’s all good knockabout stuff.
However, here’s an interesting development: the reply letter is signed by one Joan Illuzzi-Orbon. And she’s a card-carrying politically correct feminist. All the tell-tale signs are thus there to suggest that DA Vance will conduct the prosecution 100% from a right-on Orwellian bollocks perspective – one that plays extremely well to the top movers in New York City.
Here’s the evidence for that assertion….
First off, Vance is acutely aware of the prevailing political atmosphere: he has all the right words in his lexicon. Last year he initiated research to make ‘jury diversity’ compulsory. Oh dear, cultural diversity. Never mind the merit, just look at that rainbow.
Second, in May last year Vance set up a special Hate Crimes Unit. Oh double dear, hate crime. The release stated, ‘the Office will collaborate with the New York City Police Department and community organizations to develop strategies that seek to prevent bias-motivated crimes, whether based on religion, ethnicity or sexual orientation’.
Or put into Realspeak, don’t even think about being politically incorrect, or you’ll be doing the perp-walk before you can say Room 101. Hate Crime is simply a staging post on the way to Thought Crime: to date, nobody has produced any statistics on ‘bias-motivated crimes’ (more bollocks) and there’s a good reason for this. Hate Crime is an infinitessimal (but high profile and career-rewarding) sector of the total crime picture.
Guess who’s heading up the Hate Crimes Unit? None other than ‘veteran prosecutor, Assistant District Attorney Joan Illuzzi-Orbon’.
Orbon is indeed a veteran: she has form in the broad field of who-jumped-naked-on-whom – probably useful to have in this case – and has been angling for her own Hate Unit for some time. Whether she was behind the disgraceful leak of a ‘DNA link’ between Strauss-Kahn and Diallo is hard to tell: but she will know as well as Brafman that, in the end, forensics won’t drive this case. The verdict will be based on ‘he said, she said’ as to whether the alleged sex act was forced or consensual. And thus the key strategy on both sides will be to rubbish the character of the other’s client.
So far, the DA’s office has done this by demonising DSK in a manner guaranteed to wind up any juror buying into the pc world inhabited by Joan Illuzzi-Orbon – probably an inbuilt majority. Brafman’s team is playing the same game with the letter about media manipulation – but also laying great stress on demolishing the Muslim Mother Theresa persona Vance’s department wants for Nafissatou Diallo. Thus, the defence has hired investigators from the firm Guidepost Solutions to look into the woman’s background, and examine any weaknesses in her account. Guidepost Solutions’ directors include a former head of the criminal division at the New York prosecutor’s office, a former head of security at IT giant IBM and a former federal prosecutor who has worked closely with the US Secret Service. So expect some potential hacking scandals along the way.
DSK’s team has made one observation, however, with which any objective legal mind would have to agree. This relates to the ‘wide array of prejudicial information about Mr. Strauss-Kahn, including information which even if true, would never be admissible in any court’. This is right on the money, and doing it puts Cyrus Vance’s department clearly offside.
Meanwhile, the Sofitel in Manhattan (where the one-time IMF boss is suspected of sexually assaulting Diallo) is providing its housekeeping employees with alternative uniforms in response to the alleged incident.
Employees will be given the choice of wearing the new uniforms, which include trousers, or staying with the current uniforms, which include skirts and expose portions of the lower leg, according to New York Hotel Trade Commission spokesman Josh Gold. It’s that beastly man thang again, you see: they just can’t think about anything else. That why they can’t multi-task, right? On account of they’re already thinking about rape before they even start.
